  26. This End-User License Agreement ("EULA") is a legal agreement between you
  27. (either an individual or a single entity) and the mentioned author of this
  28. Software for the software product identified above, which includes computer
  29. software and may include associated media, printed materials, and "online" or
  30. electronic documentation ("SOFTWARE PRODUCT").  By installing, copying,
  31. or otherwise using the SOFTWARE PRODUCT, you agree to be bound by the
  32. terms of this EULA.  If you do not agree to the terms of this EULA, do not install
  33. or use the SOFTWARE PRODUCT.

  35. SOFTWARE PRODUCT LICENSE
  36. The SOFTWARE PRODUCT is protected by copyright laws and international
  37. copyright treaties, as well as other intellectual property laws and treaties.  The
  38. SOFTWARE PRODUCT is licensed, not sold.

  40. 1. GRANT OF LICENSE.  This EULA grants you the following rights:

  42. Installation and Use. 
  43. You may install and use one copy of the SOFTWARE PRODUCT on a single
  44. computer.

  46. 2. DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS.
  47. Limitations on Reverse Engineering, De-compilation, and Disassembly.  You
  48. may not reverse engineer, de-compile, or disassemble the SOFTWARE
  49. PRODUCT, except and only to the extent that such activity is expressly
  50. permitted by applicable law notwithstanding this limitation.

  52. Separation of Components.
  53. The SOFTWARE PRODUCT is licensed as a single product.  Its component
  54. parts may not be separated for use on more than one computer.
  55.  
  56. Software Transfer.
  57. You may permanently transfer all of your rights under this EULA, provided the
  58. recipient agrees to the terms of this EULA.
  59.  
  60. Termination.
  61. Without prejudice to any other rights, the Author of this Software may terminate
  62. this EULA if you fail to comply with the terms and conditions of this EULA.  In
  63. such event, you must destroy all copies of the SOFTWARE PRODUCT and all
  64. of its component parts.
  65.  
  66. Distribution.
  67. The SOFTWARE PRODUCT may not be sold or be included in a product or
  68. package which intends to receive benefits through the inclusion of the
  69. SOFTWARE PRODUCT.

  71. 3. COPYRIGHT.
  72. All title and copyrights in and to the SOFTWARE PRODUCT (including but not
  73. limited to any images, photographs, animations, video, audio, music, text, and
  74. "applets" incorporated into the SOFTWARE PRODUCT), the accompanying
  75. printed materials, and any copies of the SOFTWARE PRODUCT are owned
  76. by the Author of this Software.  The SOFTWARE PRODUCT is protected by
  77. copyright laws and international treaty provisions.  Therefore, you must treat
  78. the SOFTWARE PRODUCT like any other copyrighted material except that
  79. you may install the SOFTWARE PRODUCT on a single computer.

  81. 4. U.S. GOVERNMENT RESTRICTED RIGHTS.
  82. The SOFTWARE PRODUCT and documentation are provided with
  83. RESTRICTED RIGHTS.  Use, duplication, or disclosure by the Government is
  84. subject to restrictions as set forth in subparagraph (c)(1)(ii) of the Rights in
  85. Technical Data and Computer Software clause at DFARS 252.227-7013 or
  86. subparagraphs (c)(1) and (2) of the Commercial Computer Software-Restricted
  87. Rights at 48 CFR 52.227-19, as applicable.  Manufacturer is

  94. NO WARRANTIES.
  95. The Author of this Software expressly disclaims any warranty for the
  96. SOFTWARE PRODUCT.  The SOFTWARE PRODUCT and any related
  97. documentation is provided "as is" without warranty of any kind, either express
  98. or implied, including, without limitation, the implied warranties or merchantability,
  99. fitness for a particular purpose, or noninfringement.  The entire risk arising out
  100. of use or performance of the SOFTWARE PRODUCT remains with you.

  102. NO LIABILITY FOR DAMAGES.
  103. In no event shall the author of this Software be liable for any damages
  104. whatsoever (including, without limitation, damages for loss of business profits,
  105. business interruption, loss of business information, or any other pecuniary loss)
  106. arising out of the use of or inability to use this product, even if the Author of this
  107. Software has been advised of the possibility of such damages.  Because some
  108. states/jurisdictions do not allow the exclusion or limitation of liability for
  109. consequential or incidental damages, the above limitation may not apply to you.

  111. GOVERNING LAW AND SEVERABILITY.
  112. This License shall be governed by and construed in accordance with the laws
  113. of the State of Arkansas, without giving effect to any principles of conflicts of
  114. law.  If any provision of this License shall be unlawful, void or for any reason
  115. unenforceable, then that provision shall be deemed severable from this
  116. License and shall not affect the validity and enforceability of any remaining
  117. provisions.  This is the entire agreement between the parties relating to the
  118. subject matter herein and shall not be modified except in writing, signed by
  119. both parties.
